Michael Yerger v. Barry M. Barbush and Merrill, Lynch, Pierce, Fenner and Smith, NASD 04-07439. Action for breach of fiduciary duty and negligent supervision. Settled in favor of Michael Yerger on October 26, 2005, in an amount required to remain confidential by agreement of the parties. The terms of the agreement can be reviewed by examining the Barry Barbush CRD which appears on the websites of NASD and the Pennsylvania Securities Commission.
Bisker v. GGS Information Services, Inc.;1:CV-07-1465; Summary Judgment granted against Plaintiff on an ADA claim. Reversed by the Third Circuit on July 24, 2009, following oral argument. HELD: Someone may be a qualified individual for purposes of ADA and yet still be qualified to obtain Social Security disability benefits as well as long term disability benefits.
